1. Children Under the Age of 13; Minors

 

Our Products are not intended for children under 13 years of age. No one under age 13 may provide any information to or on the Products. TGE does not knowingly collect personal information from children under 13. If you are under 13, do not use or provide any information on the Products or through any of its features, register on the Products, make purchases through the Website, use any of the interactive or public comment features of the Products, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, TGE will delete that information. If you are minor, but above the age of 13 (or the minimum age for certain countries listed below), you must have parental or legal guardian’s permission to use our Products. Please have your parent or legal guardian read these terms with you. For parents or legal guardians that allow minors to use our Products, parental control protections are commercially available that may assist Users in limiting access to material that is harmful to minors. If you are concerned about your children seeing inappropriate materials online, you may want to consider a filtering program or an Internet Service Provider that offers tools to help screen out or restrict access to such material. 2. Information We Collect and How We Collect It

 

We collect activity across our Products and several types of information from and about users of our Website and Products, including:

 

  • Information by which you may be personally identified, such as name, postal address, e-mail address, telephone number, any other identifier by which you may be contacted online or offline (”personal information”);

  • The time, frequency, and duration of your activities on our Products;

  • Information from and about the different devices you use and how you use them (i.e. device and software being used, signals from device);
  • Information you’ve shared with Us through device settings (i.e. GPS location, camera access, photos, videos, content);
  • Information you provide in a public form on our Products;
  • Location information, including precise or approximate location information provided by a mobile or other device interacting with our Products, or associated with your IP addresses or other online or device identifies, where we are permitted by law to process this information;
  • Still or video images posted on our Products;
  • Call recordings if you call one our representative or customer service phone numbers;
  • Information from cookies and similar technologies;
    • In general, cookies may be used for authentication; security, site and Product integrity; potential advertisement, recommendations and measurement; analytics and research; performance; and site features and services.

 

You might choose to provide information about your religious views, your sexual orientation, political views, health, racial or ethnic origin, philosophical beliefs, or trade union membership. These and other types of information could have special protections under the laws of your jurisdiction.

 

We collect this information:

The information TGE collects on or through our Products may include:

 

  • Information that you provide by filling in forms on our Products. This includes information provided at the time of registering to use our Products, subscribing to our service, posting material, or requesting further services. TGE may also ask you for information when you report a problem with our Products;
  • Records and copies of your correspondence (including email addresses), if you contact us;
  • Your responses to surveys that we might ask you to complete for research purposes;
  • Details of transactions you carry out through our Website and of the fulfillment of your orders. You may be required to provide financial information before placing an order through our Products;
  • Your search queries on the Products.

 

You also may provide information to be posted on public areas of the Products, or transmitted to other users of the Products or third parties (collectively, “User Contributions”). Your User Contributions are posted on and transmitted to others at your own risk. Although you may set certain privacy settings for such information by logging into your account profile, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the Products with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

 

4. Information We Collect Using Automatic Data Tracking Technologies

 

As you navigate through and interact with our Products, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

 

  • Details of your visits to our Products, including traffic data, location data, logs, and other communication data and the resources that you access and use on the Products.
  • Information about your computer and internet connection, including your IP address, operating system, and browser type.

The information we collect automatically may include personal information, or we may maintain it or associate it with personal information we collect in other ways or receive from third parties. It helps us to improve our Products and to deliver a better and more personalized service, including by enabling us to:

  • Store information about your preferences, allowing us to customize our Products according to your individual interests.
  • Prepare relevant information on our Website based on your and other consumers use and navigation of it.
  • Speed up your searches.

5. Third Party Use of Cookies and Other Data Tracking Technologies

 

Some content or applications, including advertisements, on the Products are served by third-parties, including advertisers, ad networks and servers, content providers, and application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use our Products. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

 

In addition, Google Analytics is a web analytics serviced offered by Google that may track and report website traffic on our Products. Google uses the data collected to track and monitor use of Our Products. This data may be shared with other Google services. We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly. 6. How We Use Your Information

 

TGE uses information that we collect about you or that you provide to us, including any personal information:

 

  • To present our Products and its contents to you.
  • To provide you with information, products, or services that you request from us or based on your interactions from our Products.
  • To fulfill any other purpose for which you provide it.
  • To provide you with notices about your account, including expiration and renewal notices.
  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.
  • To notify you about changes to our Products or any products or services TGE offers or provides through it.
  • To better update our Products based on your and other consumers’ activity and interaction with it.
  • To allow you to participate in interactive features on our Products.
  • In any other way we may describe when you provide the information.
  • For any other purpose with your consent.

 

We may also use your information to contact you about our own and third-parties’ goods and services that may be of interest to you. If you do not want us to use your information in this way, please adjust your user preferences in your account profile.

 

We may use the information we have collected from you to enable us to display advertisements to our advertisers’ target audiences. Even though we do not disclose your personal information for these purposes without your consent, if you click on or otherwise interact with an advertisement, the advertiser may assume that you meet its target criteria.

 

We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide You with ways to choose not to have your information collected or used in this way. We do not provide services in California. However, California residents may have additional Personal Information rights and choices. Please see Section 12.

 

7. Transferring Personal Information from the EU to the US

 

TGE is headquartered in the United States. Information you provide to us or we collect from you will be processed in the United States. The United States is not currently considered by the EU to provide an adequate level of data protection. TGE therefore relies on exceptions listed in the GDPR. In particular, we collect and transfer your personal information to the United States only: with your consent; to perform services under the contracts we have in place with you; or to fulfill compelling legitimate interest of TGE that does not outweigh your rights or freedoms. TGE strives to apply suitable safeguards to protect the privacy and security of your personal information and to use it only as described in this Policy. 8. Do Not Track Requests

 

TGE may use a number of third party analytics and service providers to help us evaluate your use of the Products; compile statistical reports on activity and improve the content on the Products, as well as the Products’ performance. We only use these third-party analytics providers on certain areas of the Products. We currently do not respond to your browser’s Do Not Track signal, and we do not permit third parties other than our analytics and service providers to track TGE users’ activities over time on the Products. We do not track your online browsing activity on other online services over time.

 

9. Disclosure of Your Information

 

TGE may disclose aggregated information about our users, and information that does not identify any individual, without restriction. TGE may disclose personal information that we collect or you provide as described in this privacy policy:

 

  • To our subsidiaries and affiliates.
  • To contractors, service providers, and other third parties we use to support our business.
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of TGE’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by TGE about our Website users is among the assets transferred.
  • To third parties to market their products or services to you if you have not opted out of these disclosures. For more information, see Section 6.
  • To fulfill the purpose for which you provide it.
  • For any other purpose disclosed by us when you provide the information.
  • With your consent.

 

We may also disclose your personal information:

 

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request where We have a good faith belief that We are required by law to do so.
  • To enforce or apply our Terms of Use and other agreements, including for billing and collection purposes.
  • If TGE believes disclosure is necessary or appropriate to protect the rights, property, or safety of TGE, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

 

10. Your Rights With Respect to Your Personal Information

 

Depending on the location from where you access the Products, you may have the right to access, be in formed, rectify/correct, object, delete, or restrict use of certain personal information covered by this Policy and exercise all other rights set forth in Articles 15-22 of the General Data Protection Regulation (“GDPR”). You may also have the right to request that we refrain from processing your personal information. You may also have the right to revoke TGE’s access to Google data via the Google security settings page. Please bear in mind that if you exercise such rights this may affect TGE’s ability to provide our services. For inquiries about your personal information, please contact us. Although we will make reasonable efforts to accommodate your request, we reserve the right to impose certain restrictions and requirements on such requests, if allowed or required by applicable laws. Please note that it may take some time to process your request.

 

We may access, preserve and share your information in response to a legal request (like a search warrant, court order, or subpoena) if we have good faith belief that applicable law requires us to do so. This may include responding to legal requests from jurisdictions outside of the United States where we have a good faith belief that the response is required by law in that applicable jurisdiction, affects users in that applicable jurisdiction, and is consistent with internationally recognized standards. We may also access, preserve and share information when we have a good faith belief it is necessary to: detect, prevent and address fraud and other illegal activity; to protect ourselves, you and others, including as part of investigations; or to prevent death or imminent bodily harm. For example, we may provide information to third-party partners about the reliability of your account to prevent fraud and abuse on and off of our Products. Information we receive about you, including financial transaction data related to purchases made through our Products, may be accessed, processed and retained for an extended period of time when it is the subject of a legal request or obligation, governmental investigation, or investigations concerning possible violations of our terms or policies, or otherwise to prevent harm. We also may retain information from accounts disabled for violations of our terms for at least a year to prevent repeat abuse or other violations of our terms.

 

In general, federal law does not allow private parties to obtain the content of communications and certain information (e.g., messages, posts, videos, pictures, streams) using subpoenas. See the Stored Communications Act, 18 U.S.C. § 2701 et seq. Stored messages, emails, and other content of communications are generally prohibited from disclosure, subject to certain exceptions under 18 U.S.C. § 2702. However, TGE may provide any available basic subscriber information (not content) where the requested information is indispensable to the case, and not within a party’s possession upon personal service of a valid subpoena or court order and after notice to affected account holders. Basic subscriber information does not include content (e.g. messages, posts, videos, pictures, streams) but may include, and is not limited to, a user’s name, address, telephone number, email address, date of birth, account information, and any other information identifying a subscriber of TGE or its Products.

 

Unless an exception is applicable in which TGE is obligated to disclose user information and content of communications, requesting parties must also demonstrate that they have exhausted all other avenues of obtaining the information it seeks, such as requesting a voluntary release from the individual user or obtaining a valid court order authorizing the release of records. Upon TGE’s receipt of a subpoena or court order arising from a legal proceeding, TGE will provide notice to the individual user of the request, and give the individual user an opportunity to challenge the subpoena or court order themselves. Any such subpoena or court order should be limited in scope to seek basic subscriber information only, and set our specific accounts of TGE or its Products at issue by identifying them by their URL or TGE user ID. Names, birthdays, locations and other information are insufficient.

 

11. Accessing and Correcting Your Information

 

You can review and change your personal information by contacting us or updating through our Website if an account has been created. You may also send us an email at info@tgesolar.com to request access to, correct or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account if one exists. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

 

If you delete your User Contributions from the Website, copies of your User Contributions may remain viewable in cached and archived pages, or might have been copied or stored by other Products users. Proper access and use of information provided on the Products, including User Contributions, is governed by our Terms of Use. California residents may have additional personal information rights and choices. Please see Section 12 more information.

 

12. Your California Privacy Rights

 

We do not offer services in California currently. However, if you are a California resident, California law may provide you with additional rights regarding our use of your personal information. Among other additional rights, California residents have a right to opt out of the sale or sharing of their personal information by a business. California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of our Products that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. As a California resident, and subject to certain exceptions, you have the right to know about personal information we collect and how it is shared; the right to delete personal information collected by us; the right to opt-out of the sale or sharing of your personal information; the right to non-discrimination in exercising your CCPA rights; the right to correct inaccurate personal information collected; and the right to limit the use and disclosure of sensitive personal information collected. 13. Data Security

 

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on secure servers behind firewalls. TGE user’s personally identifiable information will be encrypted. We use a third-party payment provider to process all payments. We do not directly store any payment information.

 

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Products, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Products like message boards. The information you share in public areas may be viewed by any user of the Products.

 

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Products. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Website.

 

14. Changes to This Privacy Policy

 

It is our policy to post any changes we make to our privacy policy on this page. If we make material changes to how we treat our users’ personal information, we will notify you through a notice on the Products home page. The date the privacy policy was last revised is identified at the top of the page.
